These template terms apply to buyers, sellers, merchants, auction participants, and service providers using ezZzy Marketplace in Kuwait. They should be reviewed by a qualified Kuwaiti lawyer before commercial launch.

1. Acceptance, eligibility, and platform scope

  • These Terms of Service govern your access to and use of ezZzy Marketplace, including product listings, classifieds, auctions, service bookings, messaging, payments, and related digital tools.
  • You may use ezZzy only if you have legal capacity to form a binding contract under applicable law. If you are under 18, you may only use the platform under the involvement and supervision of a parent or legal guardian.
  • If you use ezZzy on behalf of a company, store, agency, or other legal entity, you confirm that you are authorized to bind that entity to these terms.

2. Accounts and identity responsibilities

  • You must provide accurate, current, and complete registration information and keep it updated, including your name, contact details, and any business verification information requested by ezZzy.
  • You are responsible for all activity that occurs through your account, credentials, devices, storefront, and connected payment instruments. Keep your login details secure and notify us immediately if you suspect unauthorized access.
  • We may request identity, business, age, or ownership verification at any time for compliance, fraud prevention, trust and safety review, or payout release.

3. Buying and selling terms

  • Sellers are responsible for listing items truthfully, including condition, authenticity, specifications, availability, delivery method, return terms, and any defects or usage limitations.
  • Buyers are responsible for reviewing listing details carefully before placing an order or making an offer. Submission of an order, offer, or acceptance of a quote may create a binding commitment depending on the transaction flow shown on the platform.
  • Sellers must ship, deliver, or otherwise fulfill orders within the timelines they advertise or within a reasonable period. Buyers must pay all applicable amounts, respond to delivery attempts reasonably, and not abuse refund or dispute tools.
  • ezZzy may cancel, hold, reverse, or review a transaction where fraud, safety risk, pricing error, prohibited goods, sanctions, law-enforcement request, or terms violations are suspected.

4. Auction rules and bidder obligations

  • A bid, proxy bid, or buy-now action placed through the auction experience is intended to be serious and binding. Do not bid unless you are able and willing to complete the purchase if you win.
  • Auction listings may include reserve prices, bid increments, bidder qualification rules, anti-sniping extensions, deposits, or payment deadlines. These controls form part of the auction terms for that listing.
  • Winning bidders must complete payment within the stated deadline. Sellers must deliver the auctioned item in substantially the same condition as described at listing close.
  • Bid shill behavior, artificial price manipulation, collusive bidding, duplicate-account bidding, or attempts to interfere with fair auction outcomes are strictly prohibited.

5. Service bookings and provider terms

  • Service providers must hold any licenses, permits, insurance, qualifications, or commercial registrations required for the services they advertise in Kuwait or the location where the service is performed.
  • Bookings may be subject to provider availability, scheduling windows, travel charges, cancellation rules, deposits, completion confirmation, and customer acceptance criteria shown at checkout or inside the booking flow.
  • Customers must provide accurate location, timing, access, and scope information. If a customer changes scope materially, the provider may revise pricing or reschedule subject to platform rules.
  • ezZzy is not the direct employer of independent sellers or service providers unless explicitly stated in a separate written agreement.

6. Payments, escrow, commission, and payouts

  • ezZzy may facilitate payments directly or through licensed third-party payment processors. By transacting on the platform, you authorize us and our payment partners to collect, process, hold, settle, refund, or reverse funds as needed for transaction completion, compliance, dispute handling, or fraud controls.
  • For selected transactions, ezZzy may hold funds in a pending or escrow-style status until delivery, completion confirmation, inspection window expiry, dispute resolution, or another milestone specified in the product flow.
  • Sellers and providers agree that ezZzy may deduct marketplace commissions, processing charges, advertising fees, penalties authorized under these terms, taxes where applicable, and other disclosed service fees before payout.
  • Payout timing is not guaranteed and may be delayed for verification review, chargeback exposure, suspicious activity, incomplete KYC, returns, or disputes.

7. Prohibited items and activities

  • You may not use ezZzy to list, promote, buy, sell, or arrange transactions involving illegal goods, counterfeit products, stolen property, hazardous materials, weapons where restricted, regulated medicines without authorization, adult or exploitative material, or any item barred by Kuwaiti law or platform policy.
  • You may not engage in fraud, money laundering, harassment, doxxing, spam, phishing, review manipulation, off-platform fee evasion, fake engagement, intellectual-property infringement, or abusive chargeback behavior.
  • We may remove content, freeze balances, reject listings, limit visibility, restrict messaging, suspend accounts, or report conduct to the relevant authorities where required.

8. Disputes, refunds, and platform enforcement

  • Users should first try to resolve transaction issues through the messaging and dispute tools available on the platform. ezZzy may request supporting evidence such as photos, delivery scans, chat history, invoices, or identity documents.
  • Where ezZzy offers a dispute-resolution workflow, our team may issue a platform decision for operational purposes such as refund allocation, balance holds, or payout release. That decision does not prevent any party from pursuing rights available under applicable law.
  • Refunds, reversals, partial settlements, service credits, account warnings, and listing removals may be applied where supported by transaction facts, safety concerns, or published policy.

9. Intellectual property and content license

  • ezZzy and its licensors own the platform, branding, software, designs, original content, and service marks, except for content submitted by users.
  • You retain ownership of the text, photos, logos, videos, and other material you upload, but you grant ezZzy a non-exclusive, worldwide, royalty-free license to host, copy, process, display, adapt, distribute, and promote that content for operating, securing, improving, and marketing the marketplace.
  • You must not upload content you do not have the right to use. We may remove allegedly infringing content and respond to valid notices from rights holders.

10. Disclaimers and limitation of liability

  • The platform is provided on an 'as available' and 'as is' basis to the maximum extent permitted by law. We do not promise uninterrupted availability, error-free operation, or guaranteed sales volume, booking volume, or bidding outcomes.
  • ezZzy is generally an intermediary technology platform and is not the owner of every listed item, the direct supplier of every service, or a party to every user-to-user transaction unless explicitly stated otherwise.
  • To the extent permitted by applicable law, ezZzy will not be liable for indirect, incidental, consequential, special, reputational, or lost-profit damages arising from platform use, user conduct, transaction failure, or third-party services. Any direct liability shall be limited to the greater of the transaction fees paid to ezZzy for the affected transaction or 100 Kuwaiti Dinars, except where law does not allow such limitation.

11. Governing law and Kuwait jurisdiction

  • These terms and any non-contractual obligations related to them are governed by the laws of the State of Kuwait, without regard to conflict-of-law principles.
  • Unless mandatory law requires otherwise, disputes relating to these terms or the use of ezZzy shall be subject to the competent courts of Kuwait. Before filing court proceedings, the parties are encouraged to attempt good-faith resolution through the platform's dispute channels.
